1. Eligibility: You must be at least 18 years old to upload content. By uploading any video, audio recording, photograph, written message, or other material, you confirm that you are legally able to agree to these terms.
2. Content Ownership & Responsibility: You retain ownership of the content you upload. Recordings longer than 30 seconds may be automatically trimmed so that only the first 30 seconds are stored. You confirm that you own the content or have all permissions, licenses, releases, and consent required to upload, store, display, and share it.
3. Permission From People Featured: You confirm that you have permission from every identifiable person who appears in or can be heard in the uploaded content. If the content includes a minor, you confirm that you are the minor's parent or legal guardian, or that you have permission from the minor's parent or legal guardian.
4. License to Provide the Service: You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, back up, transmit, display, resize, compress, convert, and otherwise process your content only as reasonably necessary to provide, maintain, secure, and support the NFC card and related services.
5. Prohibited Content: You may not upload content that is illegal, fraudulent, defamatory, threatening, harassing, hateful, sexually explicit, abusive, deceptive, harmful, or invasive of another person's privacy. You may not upload content that infringes copyrights, trademarks, publicity rights, privacy rights, or other third-party rights.
You may not upload malware, malicious code, phishing material, nonconsensual intimate content, confidential information without authorization, content that exploits or endangers minors, credible threats, or material that promotes unlawful violence or criminal activity.
6. Storage, Access & Sharing: Anyone with physical access to the NFC card, its QR code, or its direct URL may be able to view, listen to, copy, or share the attached media. Unless expressly stated otherwise, uploaded content should not be considered private, confidential, or accessible only by the original purchaser.
7. Content Removal & Suspension: We may restrict access to, preserve, disable, or remove content that we reasonably believe violates these terms, infringes another person's rights, creates a security or legal risk, or must be removed in response to a valid legal request. We may suspend or terminate access to a card, link, upload page, or customer account for serious or repeated violations.
8. Customer Backups: You are responsible for keeping the original file and an independent backup of all uploaded content. This service is not intended to be your only storage or archival system.
9. Service Availability: Digital media and related services are provided "as is" and "as available." We do not guarantee that any file, NFC card, QR code, URL, hosting provider, file format, or service will remain available permanently or without interruption.
Content may become unavailable because of deletion, expiration, hardware failure, software failure, security issues, third-party service interruption, legal requirements, account termination, or discontinuation of the service.
10. Limitation of Liability: To the fullest extent permitted by law, we are not responsible for lost, deleted, corrupted, inaccessible, improperly shared, or unauthorized content. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the service.
To the fullest extent permitted by law, our total liability relating to an affected product or service will not exceed the greater of the amount you paid for that affected product or service or one hundred U.S. dollars ($100).
11. Indemnification: To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless our business, owners, employees, contractors, affiliates, vendors, and service providers from claims, liabilities, damages, judgments, settlements, losses, penalties, costs, and reasonable attorneys' fees arising from your uploaded content, your use or misuse of the service, your violation of these terms, your violation of another person's rights, or your failure to obtain required permissions or consent.
12. Reporting Content: You may report illegal, infringing, private, abusive, or otherwise prohibited content by contacting us and providing the activation ID or direct URL, a description of the concern, and enough information for us to review the report.
13. Changes to These Terms: We may update these terms when reasonably necessary to reflect changes to the service, legal requirements, security practices, or business operations. Updated terms will apply from the date they are posted or otherwise presented for acceptance.
